Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Playcer mobile application, website, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions of this agreement, you must immediately cease using the Service.

2. Nature of the Service

2.1. Playcer is Not a Sportsbook

Playcer is a proprietary software platform and communication tool designed solely to facilitate private, social wagers between consenting adults. Playcer is not a sportsbook, casino, or commercial gambling operator. We do not set odds, offer betting lines, act as the "house," or participate in any wagers. Playcer does not risk its own capital on the outcome of any event and takes no proprietary position against its users.

2.2. Third-Party Administrator

Playcer acts exclusively as a neutral, third-party administrative tool. We provide the digital infrastructure for users to securely record agreed-upon terms, hold funds in escrow, track outcomes via third-party data, and ensure fair settlement of personal social bets. Playcer is the digital referee for agreements struck entirely at the discretion of the users.

3. Eligibility and Identity Verification (KYC)

3.1. Age and Capacity

You must be at least 21 years of age, or the legal age of majority in your jurisdiction of residence, to create an account and use the Service.

3.2. Mandatory Driver’s License Verification

To comply with federal and state anti-money laundering (AML) laws and jurisdictional gaming regulations, Playcer requires strict identity verification. Upon registration, users must provide a valid, unexpired, government-issued Driver’s License or State Identification Card. * Your legal state of residence is determined exclusively by the address listed on this government-issued ID.

If your Driver's License is issued by a state where peer-to-peer social wagering is prohibited by law, you will be denied access to the Service's real-money features.

3.3. Accuracy of Information

You represent and warrant that all information provided during the identity verification process is true, accurate, and belongs to you. Creating accounts on behalf of third parties or using fraudulent identification is a federal offense and will result in immediate permanent suspension and reporting to relevant authorities.

4. Mandatory Geolocation and Jurisdictional Compliance

4.1. Physical Presence Requirement

Establishing an account with a Driver's License from a permitted state is not sufficient to place a wager. You must also be physically located within a legally permitted jurisdiction ("Whitelisted State") at the exact time you initiate, accept, or settle a challenge.

4.2. Continuous Location Tracking

To ensure compliance with the Interstate Wire Act of 1961 and state laws, Playcer utilizes advanced, mandatory geolocation technology. By using the Service, you grant explicit consent for Playcer to continuously monitor, track, and record your physical location.

4.3. Anti-Spoofing Prohibition

Playcer actively detects and blocks the facilitation of wagers in restricted jurisdictions. Any attempt to circumvent geographic restrictions—including the use of Virtual Private Networks (VPNs), proxy servers, location-spoofing software, remote desktop applications, or tampered devices—is a material breach of these Terms. Such actions will result in immediate account termination and forfeiture of any pending funds.

5. User Representations Regarding Peer-to-Peer Wagers

By initiating or accepting a challenge on Playcer, you represent and warrant that:

  • You are engaging in a private, peer-to-peer social wager with another individual, and not participating in an unlicensed commercial gambling enterprise.
  • The terms, stakes, and conditions of the wager have been negotiated strictly between you and the opposing party.
  • You assume full financial responsibility for any funds committed to a wager.

6. Limitation of Liability and Dispute Resolution

Because Playcer is not a party to the wager, we rely on verified third-party data APIs to determine the outcome of verifiable events. Users agree to accept Playcer's data sources as the final, binding resolution for any tracked event. Playcer assumes no liability for subjective disagreements between users regarding the terms they independently set. In the event of a platform error, Playcer's maximum liability is limited to the return of the original funds placed in escrow for the specific wager in question.

7. Fees

Playcer charges a standard 4.5% platform fee (vig) and a 5.5% payment processing fee on payouts.

7.1. Ties & Pushes

In the event of a tie, push, or draw where no winner is determined, each party will be charged 2.75% of their wager amount (representing an equal split of the 5.5% processing fee). The remainder of each party's held funds will be refunded. No platform fee (vig) is charged on pushes. This processing fee covers payment processing costs incurred by Playcer regardless of outcome.
